Although the term may imply coverage with a "lesser" carrier not stable enough to handle your malpractice insurance risks, this is not always the case.

An admitted medical malpractice insurance carrier follows guidelines set forth by the Department of Insurance in that state. These carriers are required to file their policy forms, underwriting guidelines and rates with the Department of Insurance in the state(s) they are offering coverage and obtain approval. These carriers cannot deviate from the approved forms, guidelines and rates. In addition, admitted carriers are also part of the state guarantee fund which provides protection for policyholders in the event their carrier becomes insolvent.
A non-admitted medical malpractice insurance carrier does not have to file their forms, guidelines and rates with the Department of Insurance. These carriers retain flexibility to price each risk according to it's specific exposure, including procedures, practice type, past claims and board issues. Without non-admitted carriers, potential high loss risks, loss histories or specialty risks would be uninsurable. Non-admitted carriers are not part of the state guarantee fund.
